Welcome to Manhattan Viral. By accessing or using manhattanviral.com (the “Site”) and our services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Site.

1) Store & Services

We provide an online store offering apparel and accessories. Products are largely made-to-order via print-on-demand partners. We ship within the United States only.

2) Eligibility

You must be at least 18 (or the age of majority in your state) to use the Site or place orders.

3) Account

You may create an account to save information and view orders. You are responsible for maintaining the confidentiality of your login and for all activity under your account.

4) Products, Pricing & Availability

• Descriptions: We aim for accuracy but do not warrant that product descriptions, images, pricing, or availability are error-free.
• Changes: We may modify or discontinue products at any time without notice.
• Taxes & Shipping: Prices exclude taxes and shipping unless stated. Applicable taxes and shipping fees are shown at checkout.

5) Orders & Payment

• Order Acceptance: We reserve the right to refuse or cancel any order (e.g., suspected fraud, pricing errors, or supply issues).
• Payment: You authorize charges to your selected payment method for the full order amount, including taxes and shipping.
• Order Edits/Cancellations: Requests must be made within 1 hour of purchase via email. Once production begins, changes are not guaranteed.

6) Shipping, Risk of Loss & Delivery

• U.S. Only: We currently ship within the United States.
• Processing: Most items are produced in 2–5 business days before shipment.
• Delivery Estimates: Standard 4–8 business days; Expedited $9.99 (typically 2–4 business days). Timeframes begin after processing.
• Split Shipments: Orders may arrive in multiple packages with separate tracking.
• Risk of Loss: Passes to you upon carrier’s delivery scan to your address. See our Shipping Policy for details.

7) Returns, Refunds & Replacements

Because products are made to order, we do not accept returns for buyer’s remorse or size preference. If an item is defective, damaged, misprinted, or incorrect, contact us within 30 days of delivery for a replacement or refund. See our Return & Refund Policy for full details.

8) Intellectual Property

All content on the Site—including logos, graphics, text, designs, and images—is owned by or licensed to Manhattan Viral and is protected by intellectual property laws. You may not use, reproduce, or distribute any content without our prior written consent.

9) User Content & Reviews

If you post reviews, photos, or other content (“User Content”), you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and display the content in connection with the Site and our marketing. You represent you own or control the rights to your User Content and that it does not violate any laws or third-party rights.

10) Prohibited Activities

• Violating laws or regulations.
• Infringing others’ intellectual property or privacy rights.
• Uploading malicious code or interfering with Site operations.
• Using the Site to harass, abuse, or defame.
• Scraping or data mining without consent.

11) Third-Party Links & Tools

The Site may contain links to third-party websites or use third-party tools. We are not responsible for their content or practices. Your use of third-party services is at your own risk and subject to their terms and policies.

12) Disclaimers

To the fullest extent permitted by law, the Site and products are provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee uninterrupted or error-free operation.

13) Limitation of Liability

To the fullest extent permitted by law, Manhattan Viral (and our officers, directors, employees, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Site or purchase of products. Our total liability for any claim will not exceed the amount you paid for the product(s) at issue.

14) Indemnification

You agree to indemnify and hold Manhattan Viral (and our officers, directors, employees, and agents) harmless from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the Site.

15) Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules.

Arbitration: Except for claims eligible for small claims court, you agree that any dispute will be resolved by binding arbitration on an individual basis in New York County, NY. You waive the right to a jury trial or to participate in a class action. The Federal Arbitration Act and applicable arbitration rules govern the arbitration. You and we may each seek injunctive relief in a court of competent jurisdiction to protect intellectual property or confidential information.

16) Changes to the Terms

We may update these Terms at any time. The “Last updated” date reflects the latest version. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
